A BILL to amend article one, chapter forty-two of the code of
West Virginia, one thousand nine hundred thirty-one, as
amended, by adding thereto a new section, designated section
three-h, relating to providing that if a parent deeds
property to children and the children die first, the
property automatically reverts to the parent.
Be it enacted by the Legislature of West Virginia:
That article one, chapter forty-two of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section
three-h, to read as follows:
ARTICLE 1. DESCENT.
§42-1-3h. Automatic reversion to parent.
If a parent transfers property to his or her child, the
property shall automatically revert to the parent if the child
dies before the parent.
NOTE: The purpose of this bill is to provide that if a
parent transfers property to children and the children die first,
property automatically reverts to the parent.
